What happens if I'm charged with drink driving for the first time?

Your blood alcohol concentration will determine the offence that you will be charged with. The offence type will determine the legislative minimum licence disqualification period. For example, if you are charged with a first time offence of driving while under the influence, the minimum disqualification period is 6 months. However, it is important to know that the Magistrate can go above the minimum disqualification period at their own discretion. A first offence does put you in the best position to seek the minimum disqualification period and ask the Magistrate to exercise their discretion in not recording a conviction. Not all matters are the same and this is why it is important to seek legal advice from our experienced Cairns traffic lawyers and Innisfail traffic lawyers at the first opportunity.

How should I prepare for court?

You should ensure that you are dressed appropriately in business attire for all court appearances. If you intend to plead guilty to your traffic offence, then you should obtain some court references to provide to the court from your friends or family. We also advise that in preparation for sentence, you should participate in the Queensland Traffic Offenders Program. Upon completion of this program, you should then provide the Magistrate with a copy of your completion certificate and answers to show proof of completion.

What should I do if I receive a notice to appear for a traffic matter?

Will I be required to put an alcohol interlock in my car?

There will be specific circumstances where you will be required to participate in the alcohol ignition interlock program upon your licence disqualification period ending. Participation in this program is decided by legislation and managed by the Department of Transport and Main Roads.
