Your blood alcohol concentration will determine the offence that you will be charged with. The offence type will determine the legislative minimum licence disqualification period. For example, if you are charged with a first time offence of driving while under the influence, the minimum disqualification period is 6 months. However, it is important to know that the Magistrate can go above the minimum disqualification period at their own discretion. A first offence does put you in the best position to seek the minimum disqualification period and ask the Magistrate to exercise their discretion in not recording a conviction.
