FAQs

What should I do if I'm under police investigation?

You should exercise your right to obtain legal advice from our experienced Cairns criminal lawyers and Innisfail criminal lawyers prior to participating in an electronic record of interview with the police. It is important to remember that anything you say may be used against you as evidence in your matter. Whilst it is important to convey your side of the story, it is important that this is done in a way that protects your best interests. The police are skilful and trained in obtaining the information they need from you to establish a criminal offence.

Do I need a lawyer for a minor offence?

There are advantages in having a skilled lawyer on your side even for a minor offence. For example, having one of our skilled Cairns criminal lawyers or Innisfail criminal lawyers represent you in court could be the difference between a conviction recorded and no conviction recorded. With years of experience, our Innisfail and Cairns lawyers are trained to know what the court is looking for when considering penalties.

What's the difference between summary and indictable offences?

Summary offences are low end offences that can be dealt with in the Magistrates Court. Indictable offences are more serious of the two types and often will need to be dealt with in the higher courts such as the District Court of Queensland and/or the Supreme Court of Queensland.

How long does a criminal case typically take?

The length of your criminal matter will vary on a case by case basis. If you are charged with a minor offence and do not dispute the police facts, then matters such as this often take anywhere between 1-4 weeks to finalise. If your matter is more complex and there is case conferencing required with police prosecution to amend facts or seek a downgrade of a charge, then your matter may take longer and you can be looking at around 2-6 months to finalise your matter. Our criminal lawyers in Cairns and Innisfail will be able to advise you of anticipated timeframes during your initial consultation.

How should I dress when going to court?

Generally, business attire is appropriate for court appearances. You should ensure that you are not wearing any business logos or work uniforms. You should wear enclosed business shoes and ensure that your appearance is neat and tidy. If possible, you should also cover up any visible tattoos and take out any piercings. Also avoid wearing any controversial and/or offensive logos, colours, statements and brands.

What will happen at court?

At all court appearances you should ensure that you bow to the Magistrate upon entering the court room. Wait until your matter is called by the Magistrate and proceed to the bar table. At your first appearance, the Magistrate will want to know what you intend to do about the charge/s against you. You should always come prepared and be respectful whilst in the court room. You should ensure that any devices are switched off prior to entering the court room.
